Education

Dwain Fagerlund received his B.A. in political science,
magna cum laude from the University of North Dakota in
1986.  He received his Juris Doctor degree (with
distinction) from the University of North Dakota School
of Law in 1989 and was named to the Order of the Coif.  
He served as Articles Editor for the North Dakota Law
Review and research fellow for the Agricultural Law
Institute.

Private Practice

Dwain is licensed to practice law in North Dakota and
Minnesota state and federal courts. He practiced with the
firm of Johannson, Rust, Fagerlund, Yon & Stock, P.A. in
Crookston, Minnesota from 1989 to 2004 where he served
as Vice President and a managing shareholder.  His
practice included both plaintiff and defense work in the
following areas: commercial, insurance, governmental,
professional liability, personal injury, probate, drainage
and flood control.  Dwain is a member of the American
Bar Association, State Bar Association of North Dakota
and Minnesota State Bar Association.

Legal Consulting

In July of 2004, Dwain established the consulting and
alternative dispute resolution firm, The Lawyers
Consultant, to help attorneys and firms enhance
productivity through strategic planning, practice
management and conflict resolution.  He provides in-
house consultations, retreats and seminars.  Mr.
Fagerlund presented the seminar “Ethical and Tactical
Intelligence for Lawyers” to the Cass County Bar
Association and the North Dakota Trial Lawyers
Association.  He also presented “The Right Size for a
Small Firm” at the 2005 Minnesota State Bar Association
(MSBA) Convention.  Mr. Fagerlund presented seminars
for the MSBA Quality Mark, MSBA Practice Management
Section, Minnesota CLE Live Webcasts and the MSBA
Outreach Program.  These programs included “Focus
Your Practice” and “Top Ten Hits Toward Successful
Practice Management.”  He served as a panelist for the
Inns of Court in Fargo on the subject of balance in the life
of a lawyer.  Mr. Fagerlund also presented “A Systems
Approach to Law Practice Ethics Compliance” to the Cass
County Bar Association.  Dwain serves as Chair of the
SBAND Legal Economics Section and
on the Section
Council for
the MSBA Practice Management and
Marketing Section.

Alternative Dispute Resolution

Mr. Fagerlund is a qualified civil mediator and arbitrator
in both North Dakota and Minnesota.  He has presented
mediation seminars for the Greater Grand Forks Bar
Association and the UND Alternative Dispute Resolution
students.  Dwain also served as a panelist at the NDTLA
CLE “Judges and Lawyers:  Working Together for
Justice.”  He presented “Winning Mediation:  Practical
Tips for Settling Cases”
and "Last Minute Mediation" for
the UND Homecoming CLE.  Dwain published an article
entitled "Winning Mediation: Practical Tips for Settling
Cases" in the May 2007 issue of
The Gavel.  He is a
member of the Minnesota Bar Association Section of
Dispute Resolution.

Hearing Officer

In January of 2006, Mr. Fagerlund was appointed to serve
as a hearing officer for the North Dakota Department of
Transportation.  In this part-time position, he presides
over hearings for drivers facing suspension or revocation
of their driving privileges.
